Residential and Commercial Closings

Our office performs many residential and commercial real estate closings.  We work closely with our clients and the real estate agent.  We provide the title search, title insurance, settlement statement, deeds, and recording.  Please let us know if we can serve you for the next purchase or sale of your home or property.

Home Owners' Associations

We work closely with home owners' associations in their formation, incorporation, bylaws, disputes, and other legal needs.

Property Litigation

We work with clients in resolving cases involving property disputes, right of way and easement disputes, and any other issues that may arise.

Estate Planning*

We offer services in preparing wills, trusts, powers of attorney, health care powers of attorney, declarations of designations for natural death ("living wills"), and other related documents.  We often work with financial planners and trust administrators.  Our services also include some death tax planning* and minimizing the need for probate.

Estate Administration and Probate

We also assist in probate and estate administration after the decease of a loved one.  The courts and legal system can be a difficult maze to understand, especially when you are mourning for a recently deceased family member or friend.  We can help ease that process.  We also assist clients in trust administration.

Incorporation, Transactions, Legal Requirements

We can assist you in setting up your new business or issues involving your current business.  Our office can help you obtain and filed the proper incorporation papers with the North Carolina Secretary of State, draft your bylaws, your initial stock certificates and seals, as well as draft your minutes for your annual meeting.  Being diligent with the many formalities is necessary to retain personal limited liability for your business.

Bankruptcy: Chapters 7 & 13**

We help individuals file Chapter 7 and Chapter 13 Bankruptcies and get a fresh start.  These involve discharging some debts, affirming others, and working with creditors and credit counseling services throughout your bankruptcy case.

Our office will work with you to figure out whether you should file bankruptcy and under which chapter you might be eligible for debt relief.  As soon as the petition is filed with the bankruptcy court, creditors may no longer call you.  They must call your attorney. 

Chapter 7 bankruptcy cases generally take approximately 3-4 months.  In a Chapter 7, most of your unsecured debts (credit cards, medical bills, etc.) are discharged, giving you a fresh start.  This type of case is often called a liquidation.  However, exemption laws allow you to keep certain assets.

Chapter 13 cases involve repaying a portion of your debts through a payment plan, which lasts approximately 3-5 years.  We often can also stay foreclosure proceedings by making up the payments through the Chapter 13 plan.
